Terms & Conditions

1. Acceptance of Terms

By accessing or using Synapsmith (“the Platform”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.

2. Operator

Synapsmith is operated by Kunal Kongkan Kashyap, an individual / sole proprietor based in Assam, India.

3. Eligibility

You must be at least 18 years old. By using the Platform, you represent that you meet this requirement. If you are under 18, you may use Synapsmith only with the involvement of a parent or guardian.

4. Account Registration

  • Accounts are created via Clerk (Google / GitHub OAuth).
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate, current, and complete information (name, email, phone).
  • You may not create multiple accounts for abusive purposes.

5. Subscriptions & Billing

  • Synapsmith offers subscription-based plans. Details of each plan are available on the Platform.
  • Payments are processed by Razorpay. Your billing data (name, email, phone, subscription info) is shared with Razorpay for payment processing.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • You authorise Synapsmith and Razorpay to charge the subscription fee using your selected payment method.

6. Refund Policy

Refunds are governed by the separate Refund Policy, which forms part of these Terms.

7. Account Deletion

  • You may delete your account at any time from your account settings.
  • Account deletion is irreversible. All your personal data, websites, and generated content will be permanently removed from the server.
  • Billing transaction records may be retained for 6 years as required by Indian tax law.
  • Upon deletion, you will lose access to all Pro features and paid plan benefits. No refunds will be provided for the remaining subscription period.

8. User Content & Ownership

  • You retain full ownership of any websites, designs, code, or content you create using Synapsmith (“User Content”).
  • You grant Synapsmith a limited, non-exclusive license to host, store, and display your User Content solely to provide the service to you.
  • Synapsmith claims no intellectual property rights over your User Content.
  • You are solely responsible for the legality and compliance of your User Content.

9. Prohibited Uses

You may not use Synapsmith to create or host content that:

  • Violates any applicable Indian law or regulation.
  • Infringes on third-party intellectual property rights.
  • Contains malware, phishing links, or harmful code.
  • Promotes hate speech, violence, discrimination, or illegal activity.
  • Distributes spam or unsolicited communications.

Synapsmith reserves the right to remove violative content and terminate accounts without notice.

10. AI Services

  • The Platform uses AI APIs to assist in website generation.
  • AI-generated output may contain errors, inaccuracies, or unintended content. You are responsible for reviewing and editing all output before publishing.
  • Synapsmith does not guarantee the accuracy, reliability, or suitability of AI-generated content for any purpose.

11. Limitation of Liability

Synapsmith is provided “as is” without any warranty, express or implied. To the maximum extent permitted by Indian law:

  • Synapsmith shall not be liable for any indirect, incidental, special, or consequential damages.
  • My total liability to you shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.

12. Termination

I may suspend or terminate your access if you violate these Terms. Upon termination:

  • Your access to the Platform will cease.
  • Your User Content will be deleted within 30 days unless otherwise required by law.

You may also delete your account at any time as described in Section 7.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Assam, India.

14. Changes to Terms

I may update these Terms from time to time. Material changes will be notified via email or through the Platform. Continued use after changes constitutes acceptance of the updated Terms.
